*Average duration from receipt of complete documents. Hearing dates are set by the respective court — we file immediately and follow up actively. Some courts schedule faster, some take longer.
WHY AMICABLE — THE COMPARISON
A contested divorce in Austria typically costs € 10,000–30,000, takes one to four years and leaves scorched earth — especially where children are involved.
An amicable (uncontested) divorce requires: a marital partnership that has ceased for at least six months, mutual consent — and a complete, legally secure divorce settlement agreement. Then a single court hearing is sufficient.
Important: a “ceased marital partnership” does not mean you must live at separate addresses. Many couples live under one roof until the divorce — what matters is that married life is no longer being lived. Details below in the FAQ.

Do the maths: Commissioned separately, an amicable divorce with children billed by the hour typically costs € 3,000–5,000. A lawyer-handled property transfer is often charged at 1–2 % of the property value — for a € 400,000 flat that is € 4,000–8,000 alone, plus land register filing. Together this quickly adds up to € 7,000–13,000, spread over two mandates and duplicated coordination. With us: one mandate, one contact person, € 4,900 incl. VAT.

Court fees (as of 1 Aug 2026): € 406 divorce petition, € 406 settlement, € 609 where real estate is transferred. All our fees include VAT.

If the consensus between you breaks down, we tell you immediately. The fixed-price mandate then ends — you pay only for the services rendered up to that point, on a pro-rata basis. After that you decide freely: you can continue to instruct us at our hourly rate (€ 450/h incl. VAT) or choose other representation at any time.
ADDITIONAL SERVICES

FAIRNESS & REPRESENTATION
In an amicable divorce there is no requirement to be represented by a lawyer — and one firm cannot represent both spouses against each other. Our role is therefore clear: we draft the joint agreement on the basis of your consensus and formally represent one party in the proceedings; the other party confirms in writing that they have been informed of this and are free to seek their own advice. We put this on the table before you sign — not in the small print.
FREQUENTLY ASKED QUESTIONS
When is an amicable divorce possible?
When the marital partnership has ceased for at least six months, both spouses acknowledge the irretrievable breakdown of the marriage, and there is agreement on the consequences of the divorce — custody, contact rights, maintenance, assets, marital home.
A widespread misconception: you do not need to live at separate addresses. The marital partnership has ceased when typical married life is no longer being lived — separate sleeping arrangements, separate finances, no shared leisure life. This is possible under one roof and is very common in practice, for instance while the housing question is still open. Nobody has to move out before the divorce.
Do we both have to appear in court in person?
Yes, as a rule both of you — at a single hearing that usually lasts 15–30 minutes. Where minor children are involved, proof of parental counselling is required beforehand. We prepare you so thoroughly that the hearing is a formality.
What does the divorce cost in total?
Our fee is a fixed price (from € 1,900 incl. VAT). Court fees of currently € 812 apply in addition (€ 1,015 where real estate is transferred; as of 1 Aug 2026). You know the total before you instruct us.
What if we cannot reach agreement after all?
Then the fixed-price mandate ends — that is our Straight-Talk Guarantee. You pay only for the services rendered up to that point, on a pro-rata basis, and then decide freely: continue to instruct us at our hourly rate (€ 450/h incl. VAT), or choose other representation or mediation. We will tell you honestly which route makes sense in your situation.
